SECTION 7-501: DEFINITIONS
For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
“Garbage” shall mean rejected food wastes, including waste accumulation of animal, fruit or vegetable matter used or intended for food or that attend the preparation, use, cooking, dealing in or storing of meat, fish, fowl, fruit or vegetables, and dead animals rejected by rendering plants.
“Landfill” shall mean a landfill designated for city dumping that is licensed with the Nebraska Department of Environmental Quality.
“Refuse” shall mean putrescible and non-putrescible solid wastes, except body wastes, and including garbage, rubbish, ashes, incinerator ash, incinerator residue, street cleanings and solid market and industrial waste.
“Rubbish” shall mean non-putrescible solid wastes, excluding ashes, consisting of both combustible and noncombustible wastes such as paper, tin cans, garbage, yard clippings, wood, glass, bedding, crockery or litter of any kind that will be a detriment to the public health and safety.
“Trash” shall have its ordinary meaning except where specifically stated otherwise. (Ord. Nos. 197, 5/19/69; 327, 3/22/88)
SECTION 7-502: COLLECTION SERVICE; FEES
The city provides for the collection of garbage, rubbish, trash, and waste on a city-wide basis. Every owner, lessee, tenant, occupant, manager or other person in possession of a residence, place of business, factory, medical facility or other institution or other tract of land located inside the city limits shall pay to the city a use fee for the removal by the city of garbage, refuse and trash. Every owner, lessee, tenant, occupant, manager or other person in possession of a residence, place of business, factory, medical facility or other institution, or other tract of land located outside the city limits but within one mile of the city limits may contract with the city and pay the city a use fee for the removal by the city of garbage, refuse and trash. The use fees shall be in such amounts as the City Council shall set by resolution and keep on file in the city office. The use fees provided for herein shall be charged to each property. (Neb. Rev. SECTION 7-503: CONTAINERS
A. No person shall dispose of any item of garbage, refuse or trash except as provided in this chapter.
B. The city shall place containers at various locations inside the city limits for the collection of garbage, refuse and trash from those properties served which are located inside the city limits. The city shall also place containers at various locations outside the city limits for the collection of garbage, refuse and trash from those properties served which are located outside the city limits. The mayor and City Council, by resolution, shall designate the types of garbage, refuse and trash which persons may dispose of in the city containers. No person shall put any other type of garbage, refuse or trash into the city containers.
C. No person shall dispose of any garbage, refuse or trash which is not permitted to be disposed of in the city containers, except by:
1. Contacting the city clerk to have the city haul such garbage, refuse or trash to the city landfill and paying to the city such use fee as the City Council shall set by resolution; or
2. Hauling such garbage, refuse or trash to the city landfill at that person's expense.
D. Regulations for dumpster use:
1. DO place these items in a dumpster:
a. Normal non-animal and non-vegetable household items. Paper, cans, plastic and cardboard can be put in a dumpster; however, it is preferred that the environment be helped by taking such items that can be recycled to the trailer at 1st and Hancock.
b. Animal and vegetable items wrapped in paper or plastic. A sealed trash bag is considered wrapping.
c. Garden material and plant trimmings that are smaller than 3 feet in length and 3 inches in diameter.
2. DO NOT place these items in the dumpster:
a. Grass clippings and leaves. There is a collection area in the southwest corner of the fairgrounds for them. Do not pile grass clippings or leaves in the alley. Anyone who composts should contain it in some way.
b. Construction materials, demolition or remodeling debris.
c. Concrete, dirt, sod, plaster or other heavy materials.
d. Flammable liquids, cleaning fluid, waste oil, gasoline, paint, and paint cans that are still wet.
e. Tree limbs larger than 3 feet in length and 3 inches in diameter, along with large bushes.
f. Furniture, carpet and large appliances.
g. Engines.
h. Wire or wire fencing.
i. Tires.
j. Hot ashes.
SECTION 7-504: UNAUTHORIZED USE OF CONTAINERS; PROHIBITED
No person shall deposit in any city collection container any item of garbage, refuse or trash generated on any tract of land for which a use fee, as provided in Section 7-502, has not been paid to the city. (Ord. No. 365, 7/13/93)
SECTION 7-505: PROHIBITED ACCUMULATION AND DISPOSAL
A. It shall be unlawful for any person to keep in, on, or about any dwelling, building, or premises or any other place in the city any garbage, refuse, rubbish, or waste of any kind that may be injurious to the public health or offensive to the residents of the city unless the same is kept in receptacles not exceeding a 55-gallon capacity and as airtight as possible. All persons shall have the contents of their garbage cans removed at least once a week.
B. It shall be unlawful to throw or sweep into the streets, alleys, parks, or other public grounds any dirt, paper, nails, pieces of glass, refuse, garbage, waste, or rubbish of any kind.
C. It shall be unlawful for any person to throw, deposit, or cause to be thrown or deposited any refuse, rubbish, waste, or garbage on any vacant lot, public thoroughfare, street, alley, or public property. (Neb. Rev. Stat. §§17-121, 17-123, 17-573, 19-2106)
SECTION 7-506: DEAD ANIMALS
Any dead animal shall be immediately removed and buried by its owner and if the owner of such animal cannot be found, then it shall be removed by the city and buried by and at the expense of the city. Dead animals shall not be buried within the corporate limits of the city, nor within one mile thereof, nor in or above the course of groundwater that is used for drinking purposes by the city or its inhabitants. SECTION 7-507: LIQUIDS; HAZARDOUS MATERIALS
No person shall dispose of liquids and hazardous materials, contaminated or polluted liquids, or hazardous substances, except at such times and in such locations as may be specified by the operator of the city disposal ground; and all such deposits shall be immediately covered.
